Gateway SA Terms of use
Thank you for choosing to use Gateway SA to book your holiday or business accommodation. With the use of our service we need to make you aware of a number terms and conditions that relates to you using this service. Please ensure you familiarise yourself with these.
- Relationship with Accommodation Establishment and provision of this service:
- Gateway SA provides you with a directory service for various accommodation and activity listings. This means that Gateway SA facilitates booking transactions relating to holiday or business accommodation.
- Gateway SA is not responsible for the establishments terms and conditions that governs your stay whilst at their (the establishments) venue or providing you with the accommodation or activity listing.
- By signing and entering into this agreement, you are agreeing that you have the capacity and relevant authorisation to do so. In the instance where an individual is using this service and entering into this agreement on the basis of representing you, you hereby accept and agree that all information supplied to Gateway SA is correct.
- In the event of misrepresentation, Gateway SA will not be held liable or responsible for any damage or loss suffered by such misrepresentation. Gateway SA reserves the right to seek legal opinion and bring charges of fraud against you should we deem it necessary to do so.
- Gateway SA facilitates booking transactions between our accommodation provider and you. You hereby agree that for this facilitation of the booking, Gateway SA will charge a fifteen (15% ex VAT) percent commission on your 50% deposit or the total quoted amount.
- You hereby acknowledge that Gateway SA will provide you with an opportunity, relating to electronic transactions;
- To review the transaction
- to effect or correct any errors or omissions
- to terminate the transaction before making a 50% payment or full payment
- According to the ECT Act section 43, our contact details must be made available to you. Please find these listed at the bottom of this document.
- Gateway SA endeavours to provide you with a service at all times, where reasonably possible, and to maintain this service.
- Gateway SA will not be held responsible and can neither guarantee that the service will always be available or free of interruptions or errors.
- Process and Conditions for Requesting Quotations:
- Gateway SA presents various accommodation options on our website. Once you have found the accommodation option that suits your requirement, you need to proceed to “Request a Quote”.
- All “Request for Quote” enquiries are received by Gateway SA and a representative will manage you enquiry on your behalf at no cost or obligation to you.
- Gateway SA will inform you on availability and quoted price from the establishment. Our aim is to maintain a two (2) hour response time, however, please note that Gateway SA turnaround time is depended on how quickly we receive responses from the accommodation provider.
- Reserving your Booking:
- Once you receive the confirmation as noted in point 2.3, you will need to reserve your booking by facilitating a minimum payment of fifty (50%) deposit. Please note that Gateway SA has no control over the availability of bookings and we would strongly suggest that the fifty (50%) deposit is settled on receipt of the confirmation.
- Bookings cannot be confirmed until the aforesaid payment has been made and only once Gateway SA receives confirmation that the funds are reflecting in our account. Gateway SA will not be liable for any bookings lost due to delays in the processing of payments.
- Cancellations, No Show or Amendments to Bookings:
- Gateway SA facilitates booking transactions only and is not responsible for managing cancellations. Throughout the booking process and before facilitating a payment for your booking, you will be provided with the email address of the establishment.
- In the event that you would like to cancel or amend your booking dates, the responsibility rests with you to communicate via the supplied email address about your intention to cancel or amend the booking dates.
- Please note that Gateway SA facilitates booking transactions. Accommodation establishments cancellation policies vary and Gateway SA will not be held responsible for any loss or damage suffered by you should you wish to cancel or amend your booking with the establishment.
- In the event that a cancellation occurs, you are hereby informed that Gateway SA does not forfeit the fifteen (15%) commission. On receipt of your 50% deposit, 15% commission is deducted and the balance of the deposit is transferred to the establishment in fourty eight (48) hours.
- All communication with regarding cancellations and amended bookings remains between you and the establishment.
- Double Bookings and Non-Availability of Accommodation:
- Gateway SA accepts no responsibility when an establishment double books or provides incorrect quotations. Although Gateway SA does not promote this kind of behaviour we will try our best to find you alternative accommodation that meets with your booking request and requirements.
- Gateway SA will not be held liable for any damages or loss suffered by you as a result of a double booking or incorrect information. When using the Gateway SA service information is provided to us by the accommodation establishment and in turn this information is provided to you via email.
- Chargebacks on Card Payments:
- Fraudulent activity with regards to credit card payments is a reality and we recommend that you always keep you credit card and card details in a safe place.
- All cases of chargebacks will be investigated and reported to your banking institution. In the event of Gateway SA discovering that chargeback on your part is not valid, all damages and costs incurred by Gateway SA will be for your account.
- Establishment Advertising, Privacy and Reviews:
- Gateway SA endeavours to list reputable accommodation and activity listings. Gateway SA however will not be held responsible for any issues you experience during your stay.
- Gateway SA will also not be held responsible for any loss or damages suffered by you during your stay.
- Gateway SA is also not responsible for any false claims that are made on our website as this information is provided and uploaded by the establishment itself. We would however appreciate that in the event you feel that the accommodation provider has not lived up to what was portrayed on our website, please send us an email at info@gatewaysa.com and we will endeavour to take it up with the provider.
- The Gateway SA website is designed to allow you to post comments and reviews about your stay at an establishment/s. We reserve the right not to publish any posts or blogs which we deem to be defamatory.
- Gateway SA is committed to protecting your privacy and personal information at all times. Please refer to section 11 of the Gateway SA disclaimer link provided on our website.
- General Comments and Considerations:
- This agreement, and terms and conditions set out herewith, represents the agreement between Gateway SA and you.
- By entering into this agreement it is taken as confirmed that you are familiar with Gateway SA disclaimers policies as provided on the Gateway SA website.
- Gateway SA reserves the right to amend this agreement, and disclaimer policies, from time to time. Although Gateway SA will endeavour to inform you about these amendments, it remains your responsibility to visit our website from time to time to note any amendments to the agreement.
